The new Consumer Act is coming:
The fight against unauthorized cold calls    

StoppThe German Parliament and Federal Council of Germany have passed the "draft bill for the fight against unauthorized cold calls and for the improvement of consumer protection in certain sales practices". With it, tighter limits will be set for telemarketers. Consumers are to be able to withdraw more easily from contracts concluded by telephone.

The basic changes: 

  • Cold calls require the prior consent of the consumer. Offenses against the ban of unauthorized cold calls can be subject to high fines.
  • The suppression of caller IDs during advertising calls will be banned.
  • The right of withdrawal will be extended to contracts for the delivery of newspapers, journals and magazines as well as for the rendering of betting and lottery services.
  • For all distance contracts concerning services, consumers are entitled to a right of withdrawal until full execution of the contract.
  • In future, when replacing an existing contract for the performance of a continuing obligation with a new one, termination of the existing contract or the authorization for this is to be made in writing.

New documentation obligations for investment consultancy: All Clarity solutions fulfill the technical requirements

AufzeichnungIn February, the Federal Cabinet concluded: the "law for the revision of legal relationships for bonds from total emissions and for the improved enforceability of claims from investors arising from bad consultancy". With this law, investors' rights are to be strengthened and the Federal Government is expecting an improvement in the quality of consulting services. This results in new obligations for the documentation of consulting sessions for capital investment and funds deposits companies. A protocol of the telephone investment consultancy must be prepared and made available to the customer.

Green IT - more than just power consumption:

Green ITEver since the latest publication "Gadgets and Gigawatt" by the International Energy Agency (IEA), it has become clear: if the manufacturers of electronic devices do not make some changes, the worldwide power requirement for computers, printers, cell phones and the like will correspond to the overall power consumption of the USA and Japan by 2030.
